NorthNet
is an Internet Service Provider. The term "User" refers
to the person reading and signing this agreement. Dial-up accounts
are intended for users who intermittently access the Internet for
information, browsing, and file transfers.
1. NorthNet exercises
no control whatsoever over the content of information obtained through
our services.
2. With respect to our
services, NorthNet makes no warranties of any kind, whether expressed
or implied, including any implied warranty of merchantability or
fitness of this service for a particular purpose. NorthNet takes
no responsibility for any damages suffered by the User, including,
but not limited to, loss of data from delays, non-deliveries, mis-deliveries,
or service interruptions caused by NorthNet's own negligence or
the User's errors and/or omissions. NorthNet shall not be responsible
for busy signals or other impediments to connection to our system
over telecommunications lines. NorthNet makes no warranty with respect
to the compatibility of its software and modems with the modems
or software of User.
3. NorthNet services
may only be used for lawful purposes. Transmissions and/or materials
in violation of any US, state, or local regulation are prohibited.
This includes, but is not limited to, copyrighted material, material
legally judged to be threatening and/or obscene, or material protected
by trade secret. The User agrees to indemnify and hold harmless
NorthNet from any claims resulting from the User's use of services
provided by NorthNet that results in damage to the User or any third
party including actual costs of defense.
4. The User will not
directly or indirectly interfere or to attempt to interfere with
or compromise the operation of NorthNet in whole or in part, nor
interfere or attempt to interfere with any of the equipment that
is a part of the system, nor access or attempt to access other accounts
or restricted areas of the system. The User will use appropriate
safeguards to avoid compromising NorthNet operations.
5. NorthNet
will use reasonable precautions to maintain, but does not guarantee,
the privacy of electronic forms of communication, system use, and
personal directories. Provided, however, that NorthNet reserves
the right to monitor, intercept, or disclose electronic mail of
User in the event that NorthNet reasonably believes such actions
are necessary to ensure compliance with this Agreement or with any
applicable state or federal law. The User is hereby made to be aware
that information on the Internet is not necessarily private; therefore,
sensitive information should be encrypted. Encryption of information
is solely the responsibility of the User.
6. The User is solely
responsible for all use of his/her access account. NorthNet accounts
cannot be transferred to any other party. No more than one modem
may be in use at a time by the User. Accounts that have been transferred
to other parties, or which show other activity in violation of this
condition, may be disabled without prior notice with written notification
following not more than 30 days after the account is disabled. All
previous payments made to NorthNet will be forfeit.
7. The User is responsible
for keeping any and all passwords for NorthNet services private.
Any damages caused by use of the User's account by third parties
is solely the responsibility of the User. It is the User's responsibility
to report any suspected unauthorized use, or attempted use, of the
User's account to NorthNet.
8. Overt advertising
of products and/or services from the User's account is strictly
prohibited except as may be permitted by separate written agreement
between the parities. Users may discuss and evaluate products, announce
conferences and seminars, and share other information of mutual
interest.
9. The User's use of
other organization's networks or computing resources is subject
to their respective permission and usage policies.
10. Use of any information
obtained via NorthNet services is at the User's own risk. NorthNet
specifically denies any responsibility for the accuracy or quality
of information obtained through its services and/or for any damage
caused by viruses, Trojan Horses, worms, etc. caused to the User.
User should not store important data on equipment in use for Internet
traffic without implementing proper safe guards (e.g. virus scanning
software, backup systems, etc.).
11. Payment
is due upon receipt of invoice. Accounts are in default if payment
is not received within 30 days of invoice. If the User's payment
is returned to NorthNet unpaid, the User is immediately in default
and subject to a returned charge of $25.00 from NorthNet. Accounts
that are in default may be terminated. For service to be terminated
the User must, in writing, notify NorthNet. Service termination
does not remove the User's responsibility under these Terms and
Conditions to pay all fees incurred up to the date of service termination.

12. Accounts in default
may be subject to a late payment charge of $15.00 and an interest
charge of 1.5% per month on the overdue balance. If you default,
you agree to pay NorthNet its reasonable expenses, including attorney
and collection agency fees, incurred in enforcing its rights under
these Terms and Conditions.
13. NorthNet reserves
the right to change the rates for services provided and otherwise
modify these Terms and Conditions by notifying the User 30 days
in advance of the effective date of the change.
14. NorthNet reserves
the right to terminate and/or deny service to the User at any time
without prior written notice for violation of these Terms and Conditions.
Written notification will be sent to the User's address on file
not more than 30 days after the denial of service.
15. These Terms
and Conditions represent the complete agreement and understanding
of the User and NorthNet with respect to the subject matter herein,
and supersedes any other agreement or understanding, whether written
or oral.
